CIRCULAR ON PUBLIC CATTLE AUCTION PROCEDURES

Effective from the date of signature of this Circular, the provisions below must be observed after the conclusion of a public cattle auction sale.

I- AFTER THE CONCLUSION OF THE TRANSACTION

Once the transaction is concluded, a 48-hour period shall be observed to allow those who attended the sale to potentially file objections (oppositions):

A- An Objection is Filed Within the Deadline:

  • A/1- The transaction shall be systematically suspended.

  • A/2- A non-refundable deposit of 100,000 (one hundred thousand) FCFA shall be constituted by the complainant for the opening of the dispute.

  • A/3- An Ad Hoc Committee shall be established by the Mayor to hear the case. To this effect, the following documents must be presented:

    • a) The Unique Identification Number: In the absence of this document, the Commune’s financial services shall register the complainant as a taxpayer of the Commune.

    • b) A Notice of Search/Loss of Livestock delivered by the veterinary services of the complainant’s place of residence or by those of the location where the livestock is presumed to have stayed at the time of the disappearance of the sought-after animals.

    • c) A Health Document certifying the good health of the livestock at the time of transhumance in the Commune of Djohong (e.g., Vaccination Booklet).

    • d) A document containing the description of the livestock’s characteristics: Coat, age, breed, particular markings, etc.

  • A/4- After verification of all these documents, the phase of confrontation between the statements contained in the documents and the visible reality on the livestock will follow.

  • A/5- Should the claim be proven, the livestock shall be returned to the legitimate owner against payment of impoundment fees calculated on the basis of 5,000 (five thousand) FCFA/day and per head.

  • A/6- The Commission is not authorized to make concessions, this right being solely within the jurisdiction of the Mayor.

  • A/7- The owner shall pay the impoundment fees to the Municipal Collector against a receipt.

  • A/8- Minutes (a report) shall be drawn up at the end of the operation and signed by all members of the Committee.

B- In the Absence of an Objection:

  • B/1- The Minutes (report) of the transaction shall be drawn up.

  • B/2- The buyer shall then pay the proceeds of the sale to the Municipal Collector.

C- In the Event of an Unfounded Objection:

  • C/1- The transaction shall be concluded.

  • C/2- The buyer shall then pay the proceeds of the sale.

  • C/3- Minutes (a report) shall be drawn up to this effect and signed by all members of the Committee.

II- COMPOSITION OF THE COMMITTEE FOR REVIEW OF APPEALS

  • Chairman: Sub-Prefect or his representative,

  • Rapporteur (Secretary): The Divisional Delegate for Livestock,

  • Members:

    • The Municipal Treasurer,

    • The Brigade Commander,

    • The Special Commissioner,

    • The Representative of the Lamido.

NB: The payment of the fees due to the members of this body shall be ensured by the dispute opening deposit constituted by the complainants. /-
